The Physician Payment Sunshine Act, passed in 2013 as part of the Affordable Care Act, requires manufacturers of drugs, devices, biologicals, or medical supplies covered under Medicare or Medicaid/CHIP to report annually to CMS certain payments or other transfers of value to physicians and teaching hospitals. CMS publishes this information on its Open Payments platform.
H.R. 5539, introduced by Representatives Michael Burgess (R-TX) and Allyson Schwartz (D-PA), clarifies, as originally intended, that peer-reviewed journals such as JBMR®, journal reprints, journal supplements and medical textbooks are excluded from the reporting requirement under the Sunshine Act. This straight-forward, no-cost legislation ensures that transparency is maintained and continuing medical education for the purpose of providing improved patient care remains unobstructed and uninterrupted.
